Former National Assembly majority leader Aden Duale has praised the Appellate Court for witholding the High Court Ruling on the BBI initiative.
The Garisa Town MP however says that the good side of the bill can still be adopted but only after the 2022 general election.
“BBI is dead and can only bounce back after 2022 general election,” Duale said.
The MP,who is a close ally of deputy president William Ruto said that President Uhuru and ODM leader Raila Odinga,are victims of their own mistakes and failure to listen to alternative voices.
” It is unfortunate that the two can find themselves in a very shameful position that they could have avoided if they listened to some of us,”Duale stated
He said that it was clear that BBI was never a people’s initiative and that the process was shrowded in secrecy.
The Appellate Court threw out the appeal on the grounds that President Uhuru Kenyatta has now powers to initiate the popular initiative and the basic structure doctrine.
Duale also said that the Friday’s ruling by court of appeals seven judge bench was one sure way that sovereignty of the will of the people cannot be taken away any person be it parliament or president.
