Law Society of Kenya President Condemns Killing of Rex Kanyike Masai by Police

The Law Society of Kenya (LSK) President Faith Odhiambo has strongly condemned the tragic and unlawful killing of Rex Kanyike Masai, who was reportedly killed by rogue police officers. In a heartfelt statement, Odhiambo extended her condolences to Masai’s family, friends, and all young advocates of the rule of law and constitutionalism.

“I am deeply saddened by the untimely death of Rex Kanyike Masai at the hands of rogue, barbaric, and unlawfully violent police officers,” stated Odhiambo. “On behalf of the Law Society of Kenya and myself, I convey sincere condolences to his family, friends, and all the young patriots promoting the rule of law and constitutionalism.”

Odhiambo highlighted that the demonstrations held on Tuesday and Thursday were largely peaceful, with protesters showing no intent to damage property. Despite repeated calls for police restraint, the response was a disproportionate use of force, resulting in the maiming, harassment, and violation of the rights of peaceful protestors. The death of Rex Kanyike Masai, she noted, was the tipping point in a series of brutal acts by the police.

“Article 244(c) of the Constitution is clear that the police must comply with constitutional standards of human rights and fundamental freedoms,” Odhiambo said. “Further, Section 24 of the National Police Service Act affirms the duty of the police to protect life and property. The endangerment of lives through disproportionate use of force is not merely unethical and distasteful; it is illegal and unconstitutional.”

The LSK President emphasized the organization’s unwavering resolve to combat impunity within the police force. She revealed that the LSK has received multiple reports concerning the events leading to Masai’s murder and other instances of excessive force against protestors. The LSK is working to verify these reports and demands full cooperation from the Directorate of Criminal Investigations (DCI) and the Independent Policing Oversight Authority (IPOA) to identify the perpetrators within three weeks.

“We intend to ensure that these criminal elements within our police face the full force of the law,” Odhiambo asserted. “As we fulfill our statutory mandate, we urge members of the public to continue to express themselves and exercise their rights within the confines of the law. We must deny aggressors any opportunity to justify their illegal actions.”

Faith Odhiambo reaffirmed the LSK’s commitment to upholding the Constitution of Kenya, advancing the rule of law, and ensuring justice for all citizens. She concluded her statement with a tribute to Rex Kanyike Masai, saying, “Rest in peace, Rex Kanyike Masai.”

The LSK, established under the Law Society of Kenya Act, 2014, continues to protect and assist the public in legal matters, uphold the Constitution, and promote the administration of justice in Kenya.
