NAIROBI, Kenya – September 17, 2024 – The Law Society of Kenya (LSK) has issued a strong statement condemning the withdrawal of security for Hon. Justice Mr. Lawrence Mugambi. The move, which the LSK described as an unacceptable act of retaliation against a judge for lawfully discharging his duties, is viewed as a direct threat to the Rule of Law and the Administration of Justice in the country.
In its statement, the LSK underscored that the security of judges is fundamental to maintaining judicial independence. The withdrawal of security from Justice Mugambi, the organization argues, constitutes an unconstitutional act of intimidation against the judiciary. It also violates the responsibility of the National Police Service to protect public officials and uphold the Constitution.
“The removal of a Judge’s security detail is an unconstitutional act of intimidation against the Kenya Judiciary and offends the duty of the Police to uphold the Constitution,” the statement read.
The LSK has called upon the National Police Service to reconsider its actions, which it described as a “miscarriage of duty.” The organization demands the immediate reinstatement of Justice Mugambi’s security detail, emphasizing that such actions could erode public confidence in the country’s judicial system.
The withdrawal of security from Justice Mugambi has sparked concern within legal and judicial circles, with many viewing it as a troubling precedent that could compromise the independence of the judiciary and the effective dispensation of justice in Kenya.
The LSK continues to advocate for the protection of judges and judicial officers, insisting that their security is crucial for the fair administration of justice, free from external pressures or threats.
