Director of Public Prosecutions Renson Ingonga has dismissed media reports alleging that his office withdrew criminal charges against Farida Idriss Mohamed, who is accused of sending threatening messages to her lover, city businessman Hussein Aila Amaro.

Through his lawyers Danstan Omari and Shadrack Wambui, Ingonga clarified that the Office of the DPP has the constitutional authority to review and, if necessary, withdraw charges based on the evidence on record.

“The Office of the DPP has the powers to review charges, including withdrawing them, subject to the available evidence,” Omari stated.

Omari further emphasized that Ingonga’s office operates independently and is not influenced by external forces. He explained that the case stems from threatening messages sent over several days in 2019, following a bitter business dispute between Mohamed and Amaro involving Ksh 10 million.

Court Rejects DPP’s Withdrawal Request

On Wednesday, Milimani Law Court Magistrate Benmark Ekhubi dismissed an application by the DPP to withdraw the charges and directed that the case proceed to full hearing on February 27, 2025.

Meanwhile, Hussein Amaro Aila has filed a petition before the Public Service Commission (PSC) seeking the removal of Ingonga as DPP, alleging misuse of office. Amaro claims that the DPP withdrew the case without consulting him, violating due process.

The case is now set to continue as legal battles unfold over the DPP’s decision-making authority.
