City Lawyer Nelson Ndalila Fails to Appear in Court Over Ksh 59M Forgery Charges

 A Nairobi court has deferred the plea-taking of prominent city lawyer Nelson Ndalila, who faces four criminal charges, including forgery and attempted fraud amounting to Ksh 59 million, after he failed to appear in court on Friday.

Milimani Senior Principal Magistrate Dolphina Alego ordered that Ndalila must appear on Tuesday, May 5, for plea-taking after his legal team cited medical grounds for his absence.

However, lawyer Andrew Muge, watching brief for the complainant, opposed the deferment, claiming it was a deliberate attempt to delay proceedings.

“The accused was arrested yesterday (Thursday) and was expected in court today. His absence today is a clear indication of delaying tactics,” Muge stated.

Ndalila is currently out on a police cash bail of Ksh 50,000 following his arrest.

According to the first count, Ndalila is accused of forging a trust deed on June 2, 2023, allegedly intended to misrepresent ownership of property belonging to the late David Jonathan Grantham. He is said to have acted jointly with others not before court, with the aim of defrauding the deceased’s estate.

The fourth count reiterates the forgery allegation, stating that the falsified document—the Better Life Family Trust deed—was created to unlawfully acquire Ksh 59 million from the estate.

Prosecutors are expected to outline more details of the conspiracy once the plea is formally taken. The case now awaits Ndalila’s appearance in court on May 5, where the prosecution and defense will set the stage for what could be a high-profile legal battle involving estate fraud and legal malpractice.

The late David Jonathan Grantham is believed to have left behind a substantial estate, now entangled in a legal tussle over forged documentation.
