Abdul Haro Leads Legislative Push to Reform TSC Act, Secure Teachers’ Rights

Mandera South MP, Hon. Abdul Haro, is spearheading crucial reforms aimed at enhancing governance and equity in Kenya’s education sector. Through the Teachers Service Commission (Amendment) Bill, 2024, currently under scrutiny by the National Assembly’s Departmental Committee on Education, Haro seeks to formalize teacher allowances and create a clear legal framework for acting appointments.

The Bill, which Haro sponsors, proposes amending the Teachers Service Commission (TSC) Act to codify existing teacher allowances—including house, commuter, hardship, and special duty allowances—currently issued under TSC regulations. This formalization will provide long-overdue statutory clarity and elevate the dignity of the teaching profession.

“The lack of legal backing has created inconsistencies in teacher remuneration and recognition,” said Hon. Haro. “This Bill aims to align administrative practices with law, ensuring teachers are compensated fairly and transparently.”

A major feature of the proposal is the introduction of Section 32A, which allows TSC to appoint teachers in acting roles for durations ranging from 30 days to six months, provided they meet the required qualifications. This addresses long-standing gaps that have left acting appointments vulnerable to ambiguity and under-compensation.

Chaired by Hon. Julius Melly, the Education Committee has commenced consultations with key stakeholders, including the TSC, Kenya Union of Post Primary Education Teachers (KUPPET), the Office of the Attorney General, and the National Treasury. These engagements aim to fine-tune the Bill and ensure it reflects the needs of educators and the education system at large.

Hon. Haro’s initiative has drawn widespread support from lawmakers and education stakeholders, who view it as a necessary step toward reinforcing teachers’ rights and improving the sector’s operational efficiency.

“As we refine this legislation, my commitment is unwavering—to champion policies that uplift our teachers and affirm their central role in national progress,” Hon. Haro affirmed.

If enacted, this amendment would mark a milestone in safeguarding teachers’ welfare, enhancing morale, and driving sustainable reforms in Kenya’s education sector.
