Pre-Trial in Ksh 356M Theft Case Against Director Delayed Over Missing Police File

A pre-trial hearing in which company director Honey Khatwani is accused of stealing Ksh 356 million from his own company failed to proceed on Tuesday due to the absence of the investigating officer and missing police file.

The Office of the Director of Public Prosecutions (ODPP) requested a one-week adjournment to allow time for filing and supplying the necessary documents. However, the defence opposed the request, saying the delay was prejudicial to Khatwani, who has been waiting for the case to proceed and is eager to clear his name.

Trial Magistrate Dolphina Alego directed that the matter be heard on Thursday, July 10, after both sides agreed that the pre-trial and document submission would take place on the same day.

Khatwani, currently out on a bond of Ksh 200,000, has been charged with theft of Ksh 356 million from OKI Company, where he served as a director. According to the charge sheet, the alleged offences took place between January 1, 2020, and June 30, 2024, in Baba Dogo, Nairobi. Prosecutors claim he misappropriated the funds by virtue of his position.

Speaking to the press outside the courtroom, the complainant expressed frustration, accusing the state of using delay tactics to stall the case.
