Court Warns Investigating Officer Over Delays in Ksh 350M Fraud Case

An investigating officer narrowly avoided a warrant of arrest after being accused of delaying a case involving former company director Honey Khatwani, who is charged with stealing over Ksh 350 million.
The case came up for mention before Milimani Senior Principal Magistrate Dolphina Alego, where the prosecution, through the Office of the Director of Public Prosecutions (ODPP), sought more time to supply the defense with key documentary evidence.
However, the magistrate rejected the request and blamed the investigating officer—who was present in court—for the repeated delays. She issued a stern warning, cautioning the officer against what she described as “playing games” with the case, which could be construed as collusion with the accused to frustrate the proceedings.
The complainant, in an address outside court, echoed similar concerns, accusing the investigating officer of deliberately stalling the case. They claimed that some influential businessmen and investigators were interfering with the matter to shield the accused.
Magistrate Alego granted the prosecution a final opportunity to serve all outstanding documents to the defense. She scheduled both the pre-trial and the hearing for 10th July 2025, directing that the matter proceed without further delay.
According to the charge sheet, Khatwani is accused of embezzling Ksh 350 million from his company between January 1, 2020, and June 30, 2024, while serving as a director at the firm located in Baba Dogo, Nairobi.
He is currently out on a cash bail of Ksh 5 million or an alternative bond of Ksh 10 million.
There are also reports that the accused has been threatening witnesses, raising additional concerns over potential witness intimidation. The court is expected to address these claims in the upcoming hearing.
