Tribunal Halts UDA Disciplinary Case Against Nyeri MCA Ann Thumbi Over Alleged Links to Gachagua’s DCP

The Political Parties Dispute Tribunal has suspended summons issued by the United Democratic Alliance (UDA) party against Nyeri Nominated MCA Ann Thumbi. The action followed accusations that she associated herself with the Democratic Congress Party (DCP) and its leader, Deputy President Rigathi Gachagua.

Thumbi, through her lawyer Moses Mabeya, filed a petition seeking to overturn UDA’s disciplinary proceedings, arguing that the process lacked fairness and transparency. She claimed she had not been furnished with the evidence upon which the committee based its decision.

“Unless the tribunal intervenes, my client risks losing her MCA seat without being accorded due process,” said Mabeya during the hearing.

According to the petition, Thumbi received a letter from UDA on June 7, 2025, summoning her to appear before its disciplinary committee on June 20, 2025. The summons related to her alleged attendance at a DCP rally and accusations of incitement.

Mabeya insisted that removing a leader from office must follow specific and clearly established rules, which cannot be left to the whims of a disciplinary committee. He added that the committee ignored Thumbi’s notice of objection, dated June 20, 2025, and proceeded with the hearing, violating principles of natural justice.

“The entire process lacked impartiality, transparency, and procedural fairness, and was designed to arrive at a predetermined outcome,” said Thumbi in her affidavit.

She urged the tribunal to halt the proceedings, arguing that without judicial intervention, her constitutional rights would be infringed, setting a dangerous precedent that undermines due process within political parties.

Her lawyer sought a stay order against the disciplinary process and any decisions arising from it, including her potential removal from office or expulsion from Nyeri County Assembly committees.

Thumbi has sued the UDA party and the Chairperson of its Disciplinary Committee, Charles Njenga, stating that the intended process is unlawful and should be declared null and void.
