Sh300M Land Fraud Case Sparks Legal Tug-of-War as Complainant Opposes DPP’s Move to Withdraw Charges

An attempt by the Director of Public Prosecutions (DPP) to withdraw a high-profile land fraud case worth over Sh300 million has been sharply opposed by the complainant, reigniting tensions over justice and accountability.
The case, in which Abdirahman Muhumed Abdi alias Abdi is charged with forgery and making false documents, came up before Senior Principal Magistrate Geoffrey Onsarigo. During the court session, the prosecution informed the magistrate of the DPP’s intention to withdraw the charges.
However, the complainant, who was present in court, strongly objected to the move, claiming he had not been made aware of any such attempt to terminate the proceedings. He insisted the matter should proceed to full trial.
According to the charge sheet, Muhumed is accused of forging land documents in a scheme to defraud PANSIBA Limited of prime land—LR No. 209/10848 and LR No. 209/10849—measuring approximately 0.8 hectares and collectively valued at Sh300 million.
It is alleged that, on unknown dates and locations within Kenya, Muhumed fraudulently amalgamated the two parcels, which led to the creation of LR No. 209/16790. He is accused of forging a certificate of title for the said parcel, falsely presenting it as a genuine document issued by the Ministry of Lands and Physical Planning.
In a second count, Muhumed is charged with forging another title deed—LR No. 209/16791—and producing a provisional approval dated April 4, 2006, allegedly from the Ministry of Lands. The prosecution contends that the document was not authentic.
In the third and final count, he is accused of making a false document known as P.P.A. 2, purportedly issued by the Nairobi City County, with intent to defraud the complainant of the said land.
Muhumed has denied all charges and is currently out on bail.
Due to the controversy surrounding the proposed withdrawal, Magistrate Onsarigo has scheduled the matter for mention on August 8, 2025, when he is expected to deliver a ruling on whether the case will proceed or be withdrawn.
