A Milimani law court has issued a final warning to alleged serial fraudster Elius Kemboi Kori after he once again failed to appear for the hearing of a KSh 17 million fraud case.

On Thursday, five witnesses, including the complainant, were present in court, but proceedings stalled after Kemboi’s lawyer sought an adjournment, citing his client’s illness. The defence tabled medical documents indicating that Kemboi had been treated at a local facility and advised to take seven days of bed rest due to a chronic condition.

Trial Magistrate Benmark Ekhubi, however, expressed concern over repeated delays, noting that this was not the first time the accused had caused adjournments.

“I have noted with concern the trend by the accused persons. This is not the first time the matter is being adjourned because of the accused. I am therefore giving him the last chance,” Magistrate Ekhubi ruled, directing that Kemboi must personally appear in court at the next session, failure to which serious action will be taken.

Kemboi is accused of fraudulently obtaining assorted goods valued at KSh 17,110,000 from Kanduyi Investment Limited by falsely pretending he was in a position to pay for them.

The case will be mentioned on October 14, 2025, when the court expects the accused to attend in person for further proceedings.
