The Employment and Labour Relations Court has with immediate effect suspended the extension of service term of current Nairobi City Water and Sewage Company Managing Director Nahshon Muguna until case challenging the extension is heard and determined.
‘‘The application is certified urgent. I direct that it be served upon the Respondents and be heard
inter partes on the 20th January 2025. In the meantime the application is allowed in teems of
prayers 1 and 2,’’ Hon. Lady Justice H. Wasilwa ordered.
Petitioner George Otieno through Sheria Mtaani na Shadrack Wambui Organization avers that the extension of the service limit by the water agency was unlawful and contradicts provisions of legal framework and Constitution at large.
‘‘THAT this Application and the Petition filed herewith be certified as urgent and heard on a priority basis; THAT in the interim pending the hearing and determination of this Application, a conservatory order do issue staying the implementation and enforcement of the decision by the 2nd Respondent & Interested Parties’, and communicated vide a letter dated 6th November 2024, extending the 1st Respondent’s term as Managing Director after 27th May 2025,” Otieno said.
