The Kenya Civil Society Reference Group has slam the government for what they term as implementation of Public Benefits Organizations Act 2013.

According to Civil Society Reference Group president David Otieno the act provides for interested parties together with Cabinet Secretary to come up with relevant regulations.

“The  regulations must be drafted in consultations with all grassroots organisation because that is what Section69 of the Act says. You can not purport to implement regulations that we are not Party to. So we are asking the government to avoid those unscrupulous means of trying  unfairly target the civil society groups.” He said.

The Act is not yet to be fully implemented a move that the Civil Society Reference Group says is intentional.

“Before making Regulations under this section, the Cabinet Secretary shall, unless public interest requires that the Regulations be made without delay, comply with the following—(a) the intention to make Regulations shall be announced by notice in the Gazette and in at least two daily newspapers of national circulation specifying—(i) that draft Regulations have been developed for comments;(ii) the place where a copy of the draft Regulations may be  obtained;(b) a period of at least one month from the date of the notice shall be allowed for interested parties to comment on the draft Regulations; (c) comments received on the draft. Regulations shall be considered before making the Regulations.’’ Section 69 Reads in Part.
