The Law Society of Kenya (LSK), under the leadership of President Faith Odhiambo, has strongly condemned the police brutality witnessed during Thursday’s protest against the Finance Bill 2024. The protest resulted in the tragic death of Rex Masai, an innocent and unarmed demonstrator who was allegedly shot by police.

President Odhiambo urgently called for justice and the immediate apprehension of the officer responsible for the fatal shooting. “All officers who fail to adhere to the code of conduct must be brought to book and prosecuted,” she emphasized. She also called upon Inspector General of Police Japheth Koome to swiftly take action against the errant officer.

The LSK announced its intention to institute legal proceedings against police officers found to have violently attacked peaceful protesters during the demonstrations. President Odhiambo reiterated that the right to protest is enshrined in the constitution and that no Kenyan should face persecution or unwarranted aggression for exercising this right.

“We reiterate our stern warning to officers of the National Police Service across the country that acts of violence and arbitrariness will be met with strong opposition and personal legal consequences,” said President Odhiambo.

She further indicated that the LSK is already investigating incidents where Kenyans were subjected to violence while expressing their opposition to the proposed new taxes. “We are taking a detailed record of all atrocities being perpetrated by officers contrary to their duty to protect all citizens and will commence necessary legal action against all officers identified acting unlawfully,” she stated.

The Finance Bill 2024 has sparked widespread protests due to its perceived harsh economic measures. The LSK’s stance highlights the urgent need for accountability and justice in the face of state violence, reinforcing the importance of upholding constitutional rights and the rule of law.
