Nairobi County Set to Cancel Several title deeds

Nairobi City County has approved steps for revocation and cancellation of several parcels of land in a move to safeguard County public Utility land.

In a circular by the County Secretary Patrick Analo after a meeting chaired by Nairobi Governor Johnson Sakaja, the County Executive Committee approved that a 15-acre piece of land be repossessed in Mathare Sub- County that is proposed for a County Aggregation and Industrial Park (CAIP) which had, in 2006, been subdivided into 37 plots and whose allottees had processed deed plans and title deeds.

They stated that the Implementation of the CAIP requires that the existing private titles be revoked and cancelled.

In addition, the land on which Nairobi City County Upper Hill Day Nursery School in Langata Sub-County stands, and for which two title deeds that have been produced by private entitles, are to be repossessed. The nursery school is an operational county facility with over 200 children, and the titles to the private entities were issued when the school was already in operation.

Further, the land on which Kimathi Early Childhood Development Education (ECDE) stands, in Embakasi West Sub-County, and for which a private entity has produced a title deed for a shopping mall, will also be repossessed.

The individual has threatened to demolish the ECDE Centre on account of holding a land title. The land was originally set aside for a shopping centre and a community hall during the planning of Kimathi Estate, before the residents opted for a school.

“The Cabinet also discussed proposed new measures for safeguarding County Public Utility Land. The County Executive Committee resolved to invite the Ethics and Anti-Corruption Commission (EACC) to investigate circumstances under which the public land was grabbed, and titles produced. This is with a view to cancelling the titles and taking action against those involved in the illegal alienation of public land,” Anallo stated.

The Cabinet approved a raft of measures to prevent misappropriation of county public land while applicants for planning proposals with surrenders will henceforth be required to sign transfer instruments for the surrenders in Favour of the County Government before issuance of final approvals and certificates.

The County government resolved to explore legal instruments to register county public utility land.
